Rubbish Collection Docklands Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Collection Docklands provides waste and rubbish collection services to domestic and commercial customers. By placing a booking, you agree to be bound by these Terms and Conditions, which apply to all services unless otherwise agreed in writing.
Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business or organisation requesting or receiving rubbish collection or related services from Rubbish Collection Docklands.
Services means any rubbish collection, waste removal, waste handling, clearance, loading, transportation, recycling, disposal, or related services carried out by or on behalf of Rubbish Collection Docklands.
Waste means any items, materials, debris or rubbish to be collected and removed by Rubbish Collection Docklands as part of the Services, excluding Prohibited Waste.
Prohibited Waste means any waste that cannot legally or safely be collected, carried or disposed of under applicable law or which Rubbish Collection Docklands reasonably refuses to handle, including but not limited to hazardous, toxic, clinical, chemical and certain electrical items as further described in these Terms and Conditions.
Scope of Services
Rubbish Collection Docklands provides waste and rubbish collection services to residential and commercial properties within its operational service area. The exact scope of each job, including collection point, estimated volume or weight, type of waste and any access requirements, will be agreed at the time of booking or on arrival at the collection site.
Services may include one-off collections, scheduled collections, bulky item removal, light loading and clearance work, as agreed. Any services not expressly agreed at the time of booking, or that materially differ from the description provided, may be refused or may incur additional charges, which will be notified to the Customer before work continues.
Booking Process
Bookings may be made by telephone, email or any ordering channel operated by Rubbish Collection Docklands from time to time. When placing a booking, the Customer must provide accurate and complete information, including:
1. Full address and location of the collection.
2. Contact details of the person responsible on site.
3. Description of the waste to be collected, including type, approximate volume, weight and any special handling requirements.
4. Details of access restrictions such as parking limitations, time constraints, stair access or security procedures.
Any quotation issued in advance is based on the information supplied at the time of booking. Rubbish Collection Docklands reserves the right to adjust the price if, on arrival, the actual waste, volumes, access or conditions differ from those described. The operative or team on site will explain any change in price before work begins or continues.
All bookings are subject to availability and acceptance by Rubbish Collection Docklands. We reserve the right to decline or cancel a booking at our discretion, including where the waste is unsuitable, unsafe or prohibited by law.
Prices and Quotations
Prices are usually based on a combination of estimated waste volume or weight, type of material, labour time required, access difficulties and disposal or recycling charges. Any price given prior to collection is an estimate only and may be revised once the waste is physically assessed on site.
Where possible, Rubbish Collection Docklands will confirm a fixed price before commencing the work. If the Customer does not agree to a revised price, the team may leave the site without carrying out the Services, and a call-out or cancellation fee may be charged in accordance with these Terms and Conditions.
All prices are stated in pounds sterling and may be subject to applicable taxes. Any additional charges, such as parking fees, congestion charges or special disposal fees for specific waste streams, will be notified to the Customer where relevant.
Payments and Invoicing
Unless agreed in advance, payment is due immediately upon completion of the Services. Rubbish Collection Docklands accepts common payment methods such as cash, card or bank transfer, subject to availability at the time of service.
For business Customers with approved accounts, payment terms will be confirmed separately, typically within a specified number of days from the date of invoice. Invoices will set out the date of service, location, description of work and total amount payable.
If payment is not received by the due date, Rubbish Collection Docklands reserves the right to charge interest on the outstanding balance at the statutory rate, together with any reasonable costs incurred in recovering the debt, including collection agency fees and legal costs.
Rubbish Collection Docklands retains the right to suspend further Services to any Customer whose account is overdue, and to require payment in advance for any future work.
Cancellations and Amendments
The Customer may cancel or amend a booking by contacting Rubbish Collection Docklands as soon as reasonably possible. Where a Customer cancels a booking with adequate notice, no cancellation fee may apply. Where cancellation occurs with short notice or when the team is already en route or on site, a cancellation or call-out charge may be payable to cover time and costs incurred.
Rubbish Collection Docklands will explain any applicable cancellation charges at the time of booking or confirmation. Failure to provide access to the property or waste at the agreed time may be treated as a late cancellation and charged accordingly.
We reserve the right to cancel or reschedule a booking if we are unable to safely perform the Services due to extreme weather, access problems, vehicle breakdown, staff illness, regulatory restrictions or other circumstances beyond our reasonable control. In such cases, we will seek to rearrange the booking at a mutually convenient time.
Customer Obligations and Access
The Customer is responsible for ensuring that:
1. The collection location is safe, accessible and suitable for our vehicles and team.
2. Any required permissions or permits, such as building or estate access, are obtained in advance.
3. Parking or stopping space is available within reasonable distance of the collection point.
4. The waste is clearly identifiable and separated where necessary, and that Prohibited Waste is not presented as part of the collection.
If there are access issues, parking restrictions or delays caused by the Customer or third parties on site, additional waiting time or access charges may apply. Rubbish Collection Docklands reserves the right to refuse to undertake or to suspend the Services where access is unsafe or where the team reasonably believes continuing would put people, property or the environment at risk.
Prohibited and Hazardous Waste
Rubbish Collection Docklands does not generally handle certain types of waste, including but not limited to:
1. Asbestos or materials containing asbestos.
2. Clinical or medical waste, including sharps.
3. Chemical, corrosive, flammable or explosive substances.
4. Gas bottles or pressurised containers.
5. Oil, fuels, solvents and significant quantities of paint.
6. Unidentified drums or containers with unknown contents.
7. Radioactive materials.
8. Any waste that is illegal to possess, transport or dispose of.
The Customer must declare in advance any waste that may require special handling or disposal. If Prohibited Waste is discovered during collection, Rubbish Collection Docklands may refuse to remove it, may leave it on site, or may make alternative arrangements at additional cost, subject to regulatory permissions.
Waste Handling, Recycling and Disposal
Rubbish Collection Docklands endeavours to handle waste responsibly and in accordance with applicable UK waste legislation and guidance. This may include segregating materials for recycling, reuse or energy recovery where possible and commercially viable.
By engaging our rubbish collection services, the Customer authorises Rubbish Collection Docklands to remove, transport and dispose of the waste on their behalf. Title to the waste may pass to Rubbish Collection Docklands at the point of collection, subject to applicable regulations and waste duty of care requirements.
Rubbish Collection Docklands uses licensed waste transfer stations or disposal sites and will take reasonable steps to ensure that waste is managed in compliance with environmental legislation. However, specific disposal routes, recycling percentages or end destinations may vary and are not guaranteed unless expressly agreed in writing.
Duty of Care and Customer Warranties
The Customer warrants that:
1. They either own the waste or have the full authority of the owner to arrange for its removal and disposal.
2. The waste presented for collection does not contain Prohibited Waste unless previously agreed and arranged.
3. All information supplied regarding the waste and site conditions is complete and accurate.
The Customer remains responsible for complying with their own legal obligations under waste regulations, including any duty of care that applies to commercial producers of waste. Rubbish Collection Docklands will provide appropriate documentation where required, such as waste transfer notes for controlled waste streams.
Liability and Limitations
Rubbish Collection Docklands will provide the Services with reasonable care and skill. However, our liability to the Customer is subject to the following limitations:
1. We are not liable for any indirect, consequential or purely economic loss, including loss of profit, loss of business, loss of opportunity or loss of reputation.
2. We are not liable for any damage to items or fixtures that were already defective, poorly installed or in a fragile or unsafe condition prior to our attendance.
3. We are not responsible for loss or damage arising from inaccurate instructions or incomplete information supplied by the Customer.
4. Our total liability for any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total price paid or payable for the specific job giving rise to the claim, except where such limitation is not permitted by law.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or any other liability which cannot lawfully be limited or excluded.
Damage to Property
Rubbish Collection Docklands will take reasonable care to avoid damage to property while carrying out the Services. The Customer should inform our team of any vulnerable surfaces, delicate fixtures or restricted areas on site.
Where damage is alleged to have occurred as a result of our Services, the Customer must notify us as soon as reasonably practicable, providing evidence such as photographs and a description of the incident. We may inspect the damage and, where appropriate, propose a remedy or compensation within the limits set out in these Terms and Conditions.
Insurance
Rubbish Collection Docklands maintains appropriate insurance cover in respect of its operations, including public liability insurance, subject to policy terms, conditions and exclusions. Details of insurance cover can be provided on reasonable request.
Health and Safety
Rubbish Collection Docklands takes health and safety seriously and complies with applicable laws and guidance regarding the protection of staff, Customers and the public.
The Customer must not request or require our team to undertake any activity that is unsafe, unlawful or beyond the agreed scope of Services. Our staff may refuse to carry out any task they reasonably believe could cause injury, damage or breach of regulations.
Force Majeure
Rubbish Collection Docklands will not be liable for any delay or failure to perform the Services where such delay or failure is caused by events beyond our reasonable control, including but not limited to extreme weather, natural disaster, fire, flood, war, civil disturbance, labour disputes, epidemic, pandemic, fuel shortages, or the acts or omissions of third parties such as local authorities or site managers.
Where a force majeure event occurs, we will notify the Customer where reasonably possible and seek to rearrange the Services as soon as conditions allow.
Data Protection and Privacy
Rubbish Collection Docklands may collect and process personal data such as names, contact details, service addresses and payment details for the purpose of providing the Services, managing bookings, processing payments and maintaining records. Personal data will be handled in accordance with applicable data protection law.
Customer information may be shared with staff, contractors, payment processors and other service providers as reasonably necessary to deliver the Services, prevent fraud or comply with legal obligations.
Changes to Terms and Conditions
Rubbish Collection Docklands may update or amend these Terms and Conditions from time to time. The version in force at the time of booking will typically apply to that specific service. Customers are encouraged to review the latest Terms and Conditions before confirming a booking.
Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms and Conditions, together with any written quotation or confirmation of booking issued by Rubbish Collection Docklands, constitute the entire agreement between the parties in relation to the Services and supersede any previous understandings, representations or agreements, whether oral or written.
